Service Description

Interactive Media Services (the Organizer) and Upstream (the Provider) will launch a new Interactive SMS skills based service (the Service) exclusively for Safaricom’s (the Operator) customers. The Service gives the Operator’s customers the opportunity to participate in a skills based Service to increase their knowledge of a specific topic and to win prizes.

The Service will consist of 2 levels:

FREE Week– Free Week, involving a set of questions and answers free of charge.  Participants become exposed to the experience for the paid service.

PREMIUM – Premium Service under daily subscription cost of KES 10,00,  involving a set of questions and answers. Participants became eligible to win the monthly Prize.  

The Service is a skills based format, in which participants start from the Free week with the automatic conversion to the Premium level after 7 days. Participants in both levels are invited to participate in the Interactive service to learn more about the French language and will be awarded points for every answer.

In order to boost participation, a monthly prize will be offered to Participants who achieved the highest points.

For free level users, the daily service is an SMS text based service consisting of a set of queries about French language topics the subscriber is invited to reply to. By responding to a question, the subscriber triggers the next interaction for the day, until the daily limit is reached: 5 interactions (i.e. Mobile Originator Responses to the Service) per day is the limit.

For Premium level users, the daily service is an SMS text based service consisting in a set of queries about French language topics the subscriber is invited to reply to. By replying to the query the subscribers triggers the next query until the daily limit is reached: 5 interactions (i.e. Mobile Originator Responses to the trivia game) per day is the limit.

Registration and Cancellation

To register to the service and become a Service Participant, a Safaricom customer needs to send the communicated keyword to the dedicated short code, free of charge.

To become a Free Level Participant, a Safaricom subscriber needs to send an SMS to the shortcode 22292 for free. Any SMS sent to the shortcode 22292 (specific keywords will be communicated) will be considered as the user’s request to join the Service according to these Terms & Conditions.

To become a Premium Level Participant, a Safaricom subscriber need not send an SMS and will automatically be converted after the 7 day Free level period. If no opt out SMS is sent to the shortcode 22292 (specific keywords will be communicated) the action will be considered as the user’s request to join the Service according to these Terms & Conditions.

Participants can cancel their subscription at any time during the duration of the service, by sending a free-of-charge SMS with the keyword STOP (or any other keyword specified for unsubscription) to the short code 22292. Customers who join the service are considered Participants until they cancel their subscription.

Participants can also cancel their subscription by using the Safaricom USSD service;

Dial *200# for postpaid subscribers

Participants subscription can also be canceled at the sole discretion of the Organizer in the event a clear expression of non-interest in participating to the service is demonstrated by the Participant via SMS communication (e.g. the Participant is sending an MO message reporting “I do not want to participate”).

Participants who canceled their subscription can re-register at any given point in time during the Service by sending the defined registration keyword(s) to the dedicated short code. However, If a Participant un-subscribes during the FREE Level, and subscribes back again during free week, then will receive remaining free wee days. However if a subscriber subscribes back after 7 days from initial subscription day, then the free week has lapsed and the subscriber will be part of the Premium Level which means s/he will be charged KES 10,00 per day.

The Organizer reserves the right to cancel or amend the Service and these Terms and Conditions at any time. Any changes will be posted online at the Organizer’s website.

Subscription Charges

The daily subscription charge for Premium participants is KES 10/day (incl. Tax). Every day, Premium participants are charged via the daily billing cycle that runs while a subscription is active.

The Organizer may offer the Premium subscription at its sole discretion from time to time at a discounted rate.

In case of repeated unsuccessful charges, at sole discretion of the Organizer, Premium Level Participants can be removed from the Service.

All the interactions Participants will have with the Free and the Premium service are free of charge.

Service Duration

The Service will have a duration of 365 days. The start date will be on 14/09/2015 at hh:00:00 local time and the end date will be on 14/09/2016 at 23:59:59 (the Serviceable Period). The Organizer reserves the right to shift the start and end date by one or more weeks.

Extension of the Service may be established.

The Prize will be 120 hours of actual French Lessons as executed by Alliance Français.  

Monthly Prizes Period is defined as all calendar days for that specific month, starting from 00:00:00 of the 1st day of the month and will terminate at 23:59:59 of the last day of the specific month, which is the Serviceable Period.

For every correct answer the Participant user sends as a response to a question as Free or Premium subscriber, the Participant will receive at least 20 points.

For every incorrect answer the Participant sends as a response to a question as Free or Premium subscriber, the Participant will receive at least 10 points.

Points are not cumulative across the monthly Prize Periods.

Prizes must be accepted as awarded, cannot be exchanged for other prizes or cash different from the ones provided within the Prize Pool, and may not be transferred or exchanged. Prizes will be delivered within 120 days from the end of the Serviceable Period, at a time and place that will be made known within 30 days from the end of the Serviceable Period.


Eligibility Rules

The Service is open to residents of Kenya that are subscribers of the Operator, excluding all employees, representatives and agents of the Organizer and Operator, their respective parents and/or affiliated companies, contest suppliers, and those with whom any of the foregoing are domiciled. The person that owns the SIM card or has express authorization from the SIM card’s owner to use it is considered the Participant, regardless of the actual user of the phone.

In order to be eligible for the any Prize Level, a Free and a Premium Level Participant needs to have collected at least 1 point during the corresponding Prize Period. 

Winner selection, notification and prize forfeiture

Prizes will be assigned by skill level. A count will be held of each Participant’s points collected during the Serviceable Period and totals calculated.

The Participant with the highest total of points will be declared the winner for that Serviceable Period.In the event that we have more than one participant with the same amount of points, elimination will be by who reached this score first as all points allocations are time stamped.

    1. Every winner will be contacted by the Organizer on the mobile phone number he has used to participate in the Service. The Organizer will attempt to contact the winner at least 3 times a day over a period of 1 week, between the hours of 9am and 8pm. If the winner cannot be contacted during this period, he is disqualified and forfeits the prize and the Organizer will attempt to contact the next runner up.The winner is required to provide proof of eligibility and sign a prize acceptance form (as requested by the Organizer) before prizes can be collected. If the winner fails to provide sufficient proof within that period, he is disqualified and forfeits the prize and the next runner up is contacted.
    2. If the winner has any outstanding debts towards the Organizer, these need to be settled within 3 days from being contacted by the Organizer. If outstanding debts are not settled within that period, the winner forfeits the prize.
    3. If a winner fails to redeem his/her prize within 2 weeks from the date of contact, the first substitute will be selected to claim the prize.
    4. If the winner and all runner-ups forfeit the prize, the prize is deemed unclaimed and remains at the disposal of the Organizer.
    5. By accepting a prize, a winner consents to the use of his first name, initial of last name, city of residence, photograph and likeness in any serviceable material produced by the Organizer. Such use does not entitle the winner to any further compensation.
    6. Each Participant (physical person or MSISDN) is entitled to receive only one prize per prize category.
    7. Any expense not explicitly indicated as part of the prize, including but not limited to insurance, travel expenses, accommodation, license fees or taxes, are the responsibility of the winner.

Abuse and disqualification

    1. Participants are not allowed to use machines that send automatically SMS messages or automate/facilitate the answer process or any other alternative of sending SMS messages, other than the mobile phone (this prohibits the use of any GSM modems attached to a computer or mobile phones attached to a computer). The ORGANIZER has the right to disqualify any PARTICIPANT under the suspicion of breaching this obligation.


Organizer’s responsibilities

    1. Organizer’s responsibility is strictly limited in giving the Prizes. The Organizer cannot be held responsible for any delay or impossibility of sending or receiving SMS messages because of a technical problem. All the SMS messages will be considered received by the Organizer when they are registered in the Service’s IT system and not when they are sent by the Participant. All the SMS messages will be considered received by the Participant at the moment they were sent from the Service’s IT system. Participants recognize and accept that the journal of the informatics system of the Service’s IT System is the proof of the date, hour, minute and second of their receiving/ sending each SMS message.

Personal Data Protection

    1. By participating in the Service, the Participants expressly agree that personal data which they supply shall be processed by the Organizer for the purposes of executing the Service and also for the purpose of publicizing the Service and the Organizer. It is hereby specified that the Organizer guarantees that publicity, entailing the sharing with third parties of personal data supplied as a result of participation in the Service, (including through television, the press, leaflets and other means and formats of communication) shall be made only with respect to the winners of the Prizes and will only indicate the given names and surnames of the winners, the location of their place of residence, their images and voices (contained in photographic records, audio, video and other types of records, made with the purposes of publicity connected to the Service).  The winning Participants give, through their participation in the Service, express consent for the use of this data in formats herein defined. Following the termination of the Service, the personal data will be destroyed.
    2. In accordance with local laws and regulations, the Organizer respects the privacy of Participants of this Service, by which it is committed to the use of technology in a transparent form and in strict observance of the rights, freedom and guarantees of the citizens and by the reservation of the intimacy of their private and family life. The personal data collected within the scope of this Service will be treated as private and confidential. It shall not be disclosed to other individuals or organizations, except in the event of legislation to the contrary or where the Participants themselves authorize such. The data will be stored on servers with access controlled on a need-to-know basis and limited by passwords.


Governing Law & Amendments

This Service is organized under and governed by the laws and statutes of Kenya.

These Terms & Conditions are valid during the Service Period until amended or suspended by the Organizer.
